Terms of Service

1. Acceptance of Terms

By downloading, installing, or using StudPlan: Wall Framing Layout (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and StudPlan: Wall Framing Layout ("we", "us", or "our"), operated in Australia.

You must be at least 13 years old (or the applicable minimum age in your jurisdiction) to use the Service.

2. Service Description

StudPlan: Wall Framing Layout is a software application that provides features and tools to its users. Specific features may be added, modified, or removed from time to time as the Service evolves.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts & Registration

• You may be required to create an account to access certain features.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete registration information.
• You may not share your account or allow others to access it on your behalf.
• Notify us immediately at support@taxlite.net if you suspect unauthorised access.
• We may suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Submit content that is illegal, defamatory, harassing, or violates third-party intellectual property rights
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use the Service for large-scale automated processing or scraping without our written permission
• Circumvent any access controls, subscription limits, or security measures
• Create multiple accounts to bypass free-tier restrictions
• Upload or transmit viruses, malware, or any malicious code
• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to investigate and take appropriate action against any violation, including removing content, suspending accounts, and reporting to law enforcement.

5. Subscriptions & Payments

Free tier

StudPlan: Wall Framing Layout may offer a free tier with limited features or usage quotas. Free-tier limits and features are subject to change.

Paid subscriptions

• Paid plans unlock additional features and higher usage limits, billed monthly or annually as selected.
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
• Prices are displayed in local currency and include applicable taxes where required.
• In-app purchases are processed by Apple App Store or Google Play and are subject to their respective terms.

Cancellation & refunds

• You may cancel your subscription at any time; access continues until the end of the current billing period.
• Refunds for in-app purchases are handled by Apple or Google under their refund policies.
• We may offer refunds at our discretion for purchases made directly. Contact us within 14 days of purchase.

Price changes

We will provide at least 30 days' notice before changing subscription prices. Continued use after the effective date constitutes acceptance of the new price.

6. Intellectual Property

All content, trademarks, logos, software, and other materials within the Service are owned by or licensed to StudPlan: Wall Framing Layout and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works without our written consent.

You retain ownership of any content you submit through the Service. By submitting content you grant us a limited licence to process it solely for the purpose of delivering the requested feature to you.

Any feedback, suggestions, or ideas you submit to us may be used by us without obligation or compensation to you.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service or its outputs will be accurate, complete, or suitable for any particular purpose. We do not warrant that the Service will be uninterrupted or error-free.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions the above exclusions apply to the fullest extent permitted by law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDPLAN: WALL FRAMING LAYOUT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING ANY LOSS ARISING FROM RELIANCE ON THE SERVICE OR ITS OUTPUTS.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) AUD $10.

Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993, or any other non-excludable consumer-protection law that applies to you.

9. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access immediately and without notice if we determine, in our sole discretion, that you have breached these Terms, engaged in fraudulent or illegal activity, or if continued provision of the Service is not commercially viable.

On termination, your right to use the Service ceases immediately. Sections 6 (IP), 7 (Disclaimer), 8 (Liability), and 10 (Governing Law) survive termination.

10. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles.

Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand, unless applicable consumer-protection law in your jurisdiction provides otherwise.

If you are a consumer in Australia, nothing in these Terms affects your rights under the Australian Consumer Law. If you are a consumer in New Zealand, nothing in these Terms affects your rights under the Consumer Guarantees Act 1993.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via in-app notice or email at least 14 days before they take effect.

Continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service before they take effect.
